Participant Agreement

By signing where indicated below, you irrevocably agree that, if Future Force, Inc., (the “Company” or “we/us”) approves your application and accepts you as a BIG Success VIP Mastermind Program (the “Program”) participant then this Program Participant Agreement (the “Agreement”) automatically becomes a binding contract between you and the Company, and applies to your participation in the applicable Program. By signing below, you are acknowledging that you have read, agree to and accept all of the terms and conditions contained in this Agreement. We may amend this Agreement at any time by sending you a revised version at the address you provided.

By completing the Application and signing below, you authorize the Company to charge your credit or debit card, or cash your check, as indicated above, as payment for your membership in the Program, if the Company approves your Application and accepts you into the applicable Program. Furthermore, you agree that if you are accepted into our Program, you are responsible for full payment of fees for the entire 12-month course of the Program, regardless of whether you actually attend or complete the Program, and regardless of whether you have selected a lump sum or monthly payment plan. To further clarify, no refunds will be issued and all monthly payments must be paid on a timely basis. If a monthly payment becomes more than 30 days late, the entire balance becomes due and payable immediately at day 31.

We are committed to providing all Program participants with a positive Program experience. By signing below, you agree that the Company may, at its sole discretion, terminate this agreement, and limit, suspend, or terminate your participation in the Program without refund or forgiveness of remaining monthly payments if you become disruptive or difficult to work with, if you fail to follow the Program guidelines, or if you impair the participation of Program instructors or participants in the Program.

We respect your privacy and must insist that you respect the privacy of fellow Program participants. By signing below, you agree not to violate the publicity or privacy rights of any Program participant. We respect your confidential and proprietary information ideas, plans and trade secrets (collectively, “Confidential Information”) and must insist that you respect the same rights of fellow Program participants and of the Company. By signing below, you agree (1) not to infringe any Program participants or the Company’s copyright, patent, trademark, trade secret or other intellectual property rights, (2) that any Confidential Information shared by Program participants or any representative of the Company is confidential and Proprietary, and belongs solely and exclusively to the Participant who discloses it or the Company, (3) you agree not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions. By signing below, you further agree that (4) all materials and information provided to you by the Company are its confidential and proprietary intellectual property belong solely and exclusively to the Company, and may only be used by you as authorized by the Company, (5) the reproduction, distribution and sale of these materials by anyone but the Company is strictly prohibited. Further, by signing below, you agree that, if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph the Company and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations, and (6) some program elements may be altered, eliminated, or replaced for the greater good of the program and participants.

We have made every effort to accurately represent the Programs and their potential. Claims of actual earnings can be verified and examples of actual results can be provided, upon request. The testimonials and examples used are not intended to represent or guarantee that anyone will achieve the same or similar results. Each individual’s success depends on many factors, including his or her background, dedication, desire, and motivation. By signing below, you acknowledge that as with any business endeavor, there is an inherent risk of loss of capital and there is no guarantee that you will earn any money as a result of your participation in our Programs.

Under no circumstances, including, but not limited to, negligence, shall Company, their subsidiary and parent companies or affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from your use of, or the inability to use, their site or Program Materials, including messaging, blogs, comments of others, books, emails, products, or services, or third-party materials, products, or services made available through the site or by Company In any way, even if Company is advised beforehand of the possibility of such damages. (because some states do not allow the exclusion or limitation of certain categories of damages, the above limitation may not apply to you. In such states, Company’s liability and the liability of their subsidiary and parent companies or affiliates is limited to the fullest extent permitted by such state law.) You specifically acknowledge and agree that Company is not liable for any defamatory, offensive or illegal conduct of any user. If you are dissatisfied with the site, any materials, products, or services on the site, or with any of the site’s terms and conditions, your sole and exclusive remedy is to discontinue using the site and the products, services and/or materials.

The education and information presented by the Program, Program Materials and site is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. I, as an end user of this information should therefore use the contents of this Program and the materials as a general guideline and not as the ultimate source of current information and when appropriate, you understand that you should consult your own legal, accounting or other advisors.

All disputes arising under or concerning this Agreement are to be submitted to binding arbitration, in Chicago, Illinois to be resolved in accordance with the laws of the state of Illinois.

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed.

The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.

PERSONAL AND BUSINESS RESPONSIBILITY
I understand that my signature on this form registers me as a participant in Future Force Inc. events, programs and trainings and that I am applying for instruction in an activity, which may involve physical, emotional and psychological activity and that in case of such undertaking there is always a risk involved. I understand that in a group workshop setting the instructor or the staff cannot always monitor my physical, emotional and psychological limits, and that I am therefore fully responsible for assessing the risk any activity may pose to me, and that I may choose a safe course of action for myself. By signing this form I assume the risk and responsibility for any injuries or damages suffered by me arising out of my participation in any Future Force Inc. events, programs and trainings. In consideration of the opportunity to participate in Future Force Inc. events, programs and trainings I hereby release, acquit, discharge, indemnify, defend, and hold harmless, and waive all my rights to sue or be compensated by Future Force Inc., Christian Mickelsen, or any of the training instructors, guides, staff, speakers or students taking part in the events, programs and trainings in any way. I understand that Christian Mickelsen is not a doctor, and that I should consult my own health care practitioners regarding any choices and decisions I make regarding my physical, mental and emotional well-being.

I understand that while Christian Mickelsen may offer advice during his events, programs and trainings I am fully responsible for my own business, legal, and financial decisions. By signing this form, I assume the risk and responsibilities of owning my own business. In consideration of the opportunity to participate in Future Force Inc. events, programs and trainings I hereby release, acquit, discharge, indemnify, defend, and hold harmless, and waive all rights to sue or be compensated by Future Force Inc., Christian Mickelsen, or any of the training instructors, guides, staff, speakers, or students taking part in the events, programs and trainings in any way.

VOICE/IMAGE/VIDEO RELEASE
I understand that Future Force Inc. may audio/video record and/or live stream the courses I am enrolled in. I understand and agree that my voice and/or image/ video may be recorded and embodied as part of a product or promotional piece by Future Force Inc. and I grant Future Force Inc. the right to use my voice/image/video in its promotional materials and/or products. I acknowledge and agree that Future Force Inc. has complete ownership of the promotional materials and products in which my voice/image/video may appear and that I have no interest or ownership in the promotional materials and/or products or their copyright. This Voice/Image/Video Release is granted to Future Force Inc. and is perpetual and worldwide.
